§ 15.15 • ACTIONS BETWEEN REPRESENTATIVES

Subject to statutory exceptions, unless the will provides otherwise, the action of all co-representatives is required in connection with the administration and distribution of the estate.83 But if one representative is suspected of misconduct, the other representative or representatives may act. For example, where a co-representative is taking control of a corporation largely owned by the estate and is despoiling the corporation, another co-representative may seek receivership and injunctive relief.84
