§13.10 MEDIATION

Practice Tip: Mediation and other forms of alternative dispute resolution have become increasingly common in condemnation cases. The parties should be prepared to come to mediation with various experts and work on a collaborative approach to determine valuation. Further consideration should be given to selecting a mediator by agreement who possesses significant knowledge of real estate and the eminent domain process.
