§ 13.4 • LANDLORD'S LIEN (RESIDENTIAL PREMISES)

C.R.S. § 38-20-102(3)(a) grants a lien in favor of the residential landlord upon the tenant's personal property that is then on or in the rental premises. The lien attaches to the household furniture, goods, appliances, and other personal property of the tenant and members of his or her household then on the premises, but expressly excludes small kitchen appliances, cooking utensils, beds, bedding, necessary wearing apparel, personal or business records and documents, and the personal effects of the tenant and members of his or her household.

The landlord is permitted to enter the premises to assert the lien so long as landlord does not unreasonably interfere with the tenant's possession. The lien is...
