12-1 Introduction

This chapter provides an overview of summary judgment practice generally. It also examines the procedural and substantive factors particularly related to obtaining and opposing summary judgments in foreclosure lawsuits.¹ In this edition, Florida's adoption of the federal summary judgment standard, effective May 1, 2021, is discussed extensively.
