12.05. Continuation

The Delaware U.C.C. provides that if a mortgage is employed as a fixture filing, the requirements under the Delaware U.C.C. for continuation of a financing statement each five years need not be followed.24 Unfortunately, there is no case law in Delaware determining whether continuation or refiling is necessary to preserve the perfection of the original mortgage-as-fixture-filing in other circumstances where the Delaware U.C.C. would require continuations or refilings of financing statements.25
