12.05. Continuation

The Delaware U.C.C. provides that if a mortgage is employed as a fixture filing, the requirements under the Delaware U.C.C. for continuation of a financing statement each five years need not be followed.²⁴ Unfortunately, there is no case law in Delaware determining whether continuation or refiling is necessary to preserve the perfection of the original mortgage-as-fixture-filing in other circumstances where the Delaware U.C.C. would require continuations or refilings of financing statements.²⁵
