§ 11.5 • NATIONAL HISTORIC PRESERVATION ACT

The National Historic Preservation Act (NHPA) requires federal agencies, whether acting directly or indirectly, to take into account the effect of the undertaking on any historic property.98 Projects receiving federal permits such as permits for wetlands, endangered species, or any federal funding, must comply with the NHPA. The project proponents may need to conduct a cultural resource inventory to identify paleontological, archaeological and historical finds or sites on the property. If such cultural resources are identified then consultation is required between the State Historic Preservation Office or the federal permitting agency.99

Colorado's Historical, Prehistorical and Archaeological Resources Act100 establishes that development will be conducted in a manner which minimizes damage to these cultural resources.
