§10.2 NATURE OF AGREEMENT

Lawyers do not typically negotiate and prepare residential REPSAs. The Washington Supreme Court has recognized the role of real estate brokers and salespersons in residential real estate transactions and has acceded to the noninvolvement of lawyers in these transactions as a practical and economic solution. The Washington Supreme Court has also recognized the unique role of form REPSAs in residential real estate transactions by allowing real estate brokers and salespersons to fill out simple, preprinted forms that have been approved by an attorney.
