Section 10.7.2 discusses a Delaware decision, SOC-SMG, Inc. v. Day and Zimmerman, Inc.,28 holding that the arbitration panel, and not the court, should determine whether a law firm should be disqualified for ethical breaches related to discovery.

The ethics rules that apply to attorneys in arbitration start with the Colorado Rules of Professional Conduct. For the most part, these rules have also been adopted by the Colorado federal courts.

At least when the parties have agreed to AAA administration, the ABA/AAA Code of Ethics for Arbitrators in Commercial Disputes applies. These rules also...
