A phrase heard in bankruptcy courts across the country is that debtors should be given the opportunity for a fresh start. Not all cases are successful, but thanks to innovative attorneys and changes in the law, more people than ever are able get a fresh start. Chapter 1 discusses the rate of discharge in chapter 13, increased filing limits in chapter 13, and assisting low-income chapter 7 debtors who cannot afford the filing fees.

A survey of discharge rates in chapter 13 cases shows that about two-thirds of filers are granted a discharge. Despite the heated negotiations that often occur between parties, a chapter 13 debtor reaching discharge is a benefit for both debtors and creditors.

A consumer debtor's access to the relief afforded under chapter 13 has expanded to even more individuals, due to the increase in the debt limits in 2019. Now, debtors who have higher debt amounts are not forced into a cumbersome chapter 11 case or forced to liquidate under chapter 7. The increased debt limit...
