1-9 Final Judgment

The enforcement of a mortgage lien requires that a Final Judgment of Foreclosure be entered.55 A successful foreclosure action, either through summary judgment, consent, or trial, entitles the mortgagee to have the property sold and the proceeds applied against the judgment.56 The form of every Final Judgment of Foreclosure in Florida substantially follows the form set out in Florida Rule of Civil Procedure 1.996(a), even though individual jurisdictions incorporate their own language regarding circuit-specific sale procedures.
