§1.3 CEQ ADMINISTRATION OF NEPA

The authority of the CEQ under NEPA was established by executive order. In 1970, President Nixon directed the CEQ to issue guidelines instructing federal agencies on how to implement the EIS requirements of §102(2)(C). Exec. Order No. 11,514, 3 Fed. Reg. 4,247 (1970). In 1977, President Carter expanded the scope of the initial executive order by directing the CEQ to promulgate regulations to replace the existing guidelines and requiring the regulations to encompass all of the procedural provisions contained in NEPA §102(2). Exec. Order No. 11,991, 42 Fed. Reg. 26,967 (1977).
