§ 1.9 • USE OF VIDEORECORDED DEPOSITIONS

The taking and use of videorecorded depositions are governed by C.R.C.P. 30.

Videorecorded depositions may be used at trial for any purpose and under any circumstances in which a stenographic deposition could be used. C.R.C.P. 30(b)(2). The videorecorded deposition can be of enormous benefit when you have an important out-of-state witness who might not be available for trial due to health, imprisonment, or geography (e.g., an expert witness who is a practicing physician in another part of the country or unavailable for trial), but whose testimony is crucial to presenting a prima facie case.
