§ 12.1 INTRODUCTION

The principle of "separation of powers" at the state level appears in Article III, section 1, of the Oregon Constitution, which the courts have construed as generally consistent with the separation-of-powers concepts contained in the United States Constitution and other state constitutions containing shared political philosophies. See US Const, Arts I-III; Monaghan v. School District No. 1, Clackamas County, 211 Or 360, 364, 315 P2d 797 (1957).
