Your December column (Robert Schwab, "ABA leader states case for lawyers") is off the mark. The fact that defendants win more than 50 percent of the time leads me to think that the suit probably should not have been filed. Secondly, you are right that many suits are settled out of court. Much of the time this is because the company being sued knows it can win but it's cheaper to pay off than stand the cost of further...
