Racially restrictive covenants still in the public record are a reminder of the exclusion of people of color from homeownership, and despite being unconstitutional and unenforceable, their presence perpetuates the harms of past inequitable housing policies and the racial wealth gap. Earlier legislative efforts at redaction have been unwieldy and underused, and the recently enacted AB 1466 (McCarty) is intended to facilitate processes that are more effective and scalable to the many properties in California for which racially restrictive covenants remain unredacted.
