C. Nominal Damages
It is also uncertain whether an award of nominal damages will support a finding of intentional infliction of emotional distress. The court in Craig v. Andrew Aaron & Assoc. found that the tort of outrage required a "significant degree of injury as an element of the cause of action," and therefore rejected the argument that the tort could be supported by a showing of "some damages" or "nominal damages."16 Courts in other jurisdictions appear to agree.17
