Although the subject of bankruptcy is beyond the scope of this chapter, counsel should remember that the filing of a petition in bankruptcy results in an automatic stay of any foreclosure proceeding at any stage. 11 U.S.C. § 362(a).
On October 17, 2005, Congress revised the bankruptcy laws with the passage of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, Pub. L. No. 109-8, 119 Stat. 23. This Act made more comprehensive changes to the bankruptcy laws than any other law since 1978, when Congress enacted the current Bankruptcy Code.
