Bryant v. City of New York, 404 F.3d 128 (2nd Cir. 2005). Detainees who had been arrested for disorderly conduct brought a [section] 1983 action alleging a substantive due process violation as the result of overlong detention. The district court granted summary judgment for the defendants and the detainees appealed. The appeals court affirmed. The court held that the police officers' decision to detain the arrestees overnight rather than issuing desk appearance tickets (DATs) which were authorized under state law, was not objectively unreasonable.
