Bristol v. Bd. of County Com'rs. of Clear Creek, 281 F.3d 1148 (10th Cir. 2002). A man who was employed as a county jail officer sued a county sheriff and county officials under the Americans with Disabilities Act (ADA), challenging termination of his employment. The district court entered judgment in favor of the employee on several issues and following a jury trial entered judgment in favor of the employee on the remaining issues. The sheriff and county officials appealed. The appeals court reversed and remanded, finding that: the question of whether the employee was "substantially limited" was for a jury and not the district court to decide; the employee failed to articulate with appropriate precision that lifting was a major life activity on which he predicated his claim; evidence that...
