Not too long ago a senior
partner
of one of the most
prestigious antitrust law firms in the country called this re-
viewer stating he was about to
try
atreble damage action
and was seeking copies of instructions which had been used
in
prior
cases. This incident emphasized the fact
that
at
that time there was no published collection of treble damage
jury
instructions other than one of very limited circulation
which included only instructions used in movie eases,"
Antitrust Civil
Jury
Instructions, a collection of such in-
structions published by the Section of Antitrust Law of the
American
Bar
Association, furnishes the exact help so des-
perately needed by any lawyer responsible for the trial of
atreble damage action.
It
is another publication of the
Antitrust Section which represents not only the responsive-
ness of
that
Section to the needs of the bench and the bar,
but also the high professional standards of the Section's
members.
The book represents many years of collecting instructions
from
antitrust
lawyers throughout the country, the analysis
of those instructions, adiscriminating selection of the best
for use in the volumes and an arrangement which renders
them of the greatest practical use.
The typical prospective
juror
usually has some nodding
acquaintance with the concepts of negligence, contributory
negligence, warranty, disclaimer and the basic principles of
1J. Caskey and B. Scott,' Charges to the Jury, The Ad Press, Ltd.
The reviewer should disclose that sixty-four of the instructions
are from one case in which he acted as the defense counsel for the
principal defendants.
