There's plenty to consider when building a new factory or other facility. In addition to design, cost and financing, there are various permits to consider.

Builders know that they must obtain local building permits before construction. This is true for private industry as well as residential construction. However, while businesses may be familiar with local permit requirements, many do not know about the state and federal permits that must be obtained before and for operation. Failing to obtain these permits may result in substantial fines.

Following is a brief outline of the various permits issued by the Indiana Department of Environmental Management. Depending on the project, some or many of these requirements may apply to you.

It is not safe to assume that your operation does not need a particular permit. Many of these permits have complicated formulas, and companies should inquire before ruling out the state permit. Also, do not expect to get one overnight. Processing permit applications takes several weeks, and construction activity cannot take place until a permit is issued.

Look at the following general summary of permits, then call IDEM before any planned activity. For questions about procedures and fees, call (800) 451-6027 and ask for the specific office listed.

AIR PERMITS (OFFICE OF AIR MANAGEMENT)

Construction, Operation and Modification Permits--An operation that emits specific amounts of pollutants (lead, carbon monoxide, sulfur dioxide, etc.) needs a permit. Federal regulations require these permits to construct and operate new facilities, and to modify existing facilities. Also, operations that do not exceed the specific amounts of emissions still may need to register with IDEM.

Permits for National Emissions of Hazardous Air Pollutants--Facilities that emit toxic pollutants may need these permits. The pollutants include arsenic, asbestos, beryllium, benzene, mercury, vinyl chloride and coke oven emissions.

Asbestos Permits--Demolition or renovation of buildings containing asbestos or removal of asbestos from buildings requires a permit. These operations also require worker certification in asbestos removal.

WATER PERMITS (OFFICE OF WATER MANAGEMENT)

Construction Permits--This permit is required for construction of wastewater-treatment plants.
