NEGLIGENT MISREPRESENTATION

“To prove negligent misrepresentation, the [Plaintiff] must establish that
(1) [Defendant], in the course of business, gave incorrect information for the guidance of others in their business transactions;
(2) [Defendant] intended, or could reasonably foresee, that the [Plaintiff] would rely on that information;
(3) [Defendant] failed to exercise reasonable care in obtaining or communicating that information;
(4) the [Plaintiff] relied on that incorrect information;
(5) the [Plaintiff’s] reliance was justified; and
(6) the [Plaintiff’s] reliance was a cause of their damages.”
