When I started reading Mr. Blecke's response (May) to my article "Premises Liability: A Notable Rift in The Law of Foreseeable Crimes" (December 2009), I was dismayed that a fellow member of the Bar would feel the need to launch a personal attack in a scholarly journal. Even though I had written the article in a conciliatory tone and closed with a fond wish that "practitioners and trial courts alike appreciate the different paths that each jurisdiction has chosen for itself," I was being accused of impugning the judiciary and doing a disservice to the practice of law in Florida.

It is evident, however, that Mr. Blecke's quarrel is not with me, but rather with Florida's courts. The Third District Court of Appeal has staked...
