MOTION TO TRANSFER JURISDICTION AND DISMISS THE CASE

COMES NOW the Petitioner, (parent, the Indian custodian, or the Indian child's Tribe), the undersigned, and petitions the Court to transfer this action (foster care proceeding or termination of parental rights proceeding unless state's version or interpretation of the ICWA allows transfer in other proceedings) to the___ Tribal Court, (city)___, (state)___, and to dismiss this state court proceeding pursuant to the Indian Child Welfare Act, 25 U.S.C. § 1911(b). As grounds therefore, the Petitioner states:
