APPENDIX D - CHECK LIST: PROVING A MECHANICS LIEN CLAIM

A. Proving that all necessary parties have been joined.

1. That all parties in the chain of contract between the lien claimant and the owner have been made parties and have been served.
2. That all mechanics lien claimants who recorded claims for lien before the suit was filed have been named and sued.
3. That a lis pendens notice was properly recorded.
4. That "unknown necessary parties" have been named in its pleading and an affidavit of unknown necessary parties has been filed with the clerk of the court.
5. That within six months of filing of the lien claimant's pleading "unknown necessary parties" have been served by publication.
