The Mixed Waste Rule in a Nutshell
40 C.F.R. Part 266, Subpart N (66 Fed. Reg. 27218 (May 15, 2001))
Storage and Treatment Exemption
(§§266.210–.260)
Eligibility
• Must be non-DOE LLMW (excludes NARM).
• LLMW must be generated and managed under
a single NRC/NRC Agreement State license.
Conditions
• LLMW must be stored in a tank or container in
compliance with N RC/NRC Agreement State
license.
• LLMW must be stored in compliance with
chemical compatibility requirements of RCRA.
• Personnel training.
• Inventory exempt waste at least annua lly, and
inspect it at least quarterly.
• Maintain an emergency plan with contents that
meet requirements of §266.230(b)(5).
Written Notice
A certied written notice must be sent to EPA or the
authorized state, by certied delivery, within 90 days
of the eective date of the rule in an authorized state,
or when a storage unit is rst used to store condi-
tionally exempt waste. e notice must contain t he
following information: (1) name, address, RCRA ID
number; (2) NRC license number; (3) RCR A haz-
ardous waste codes and storage units proposed for
exemption; and (4) a statement t hat the generator
meets the required conditions.
Recordkeeping
All required NRC documents must be maintained,
along with the initia l notication records, return
receipts, reports of fa ilures to meet the exemp-
tion, and records supporting reclaimed exemptions.
Records of inventories, inspections, notications,
personnel training and emergency plans must be
maintained for t hree years a fter exempted waste is
sent for disposal, or in accordance with 10 C.F.R.
Part 20, whichever is longer.
Transportation and Disposal Exemption
(§§266.305–.360)
Eligibility
Must be LLM W (including DOE and NA RM) that
can be accepted at a licensed LLW disposal facility.
Conditions
• LLMW must meet or be treated to LDR
standards.
• LLMW must be placed in specic containers
when disposed: (1) a carbon steel drum; (2) an
alternative container with containment perfor-
mance equivalent to a carbon steel drum; or
(3) a high integrity container as dened by the
NRC.
• LLMW must comply with NRC/NRC Agree-
ment State requirements (for packaging and
labeling), and ma nifest and transportation
