APPENDIX E-4 Prosecution's Response to a Motion for a Bill of Particulars

The defendant contends that he is entitled to a Bill of Particulars in this case with respect to Count One of the Indictment. The government notes that this conspiracy count of the Indictment incorporates a detailed description of the manner and means of the conspiracy as well as several overt acts undertaken by the various conspirators. The second count charges defendant with using a firearm during the conspiracy charged in Count One, and the factual basis for this count was described in some detail in the affidavit underlying the complaint that served as the basis for the arrests in this case.
