§7609. Policy review

(a) Environmental i mpact

e Administr ator shal l review and comment in writ-

ing on the environmental impac t of any mat ter relat-

ing to duties and responsibilities g ranted pursuant to

this chapter or other provisions of the authorit y of the

Administr ator, contained in any (1) legislation pro-

posed by any Federal depa rtment or agency, (2) newly

authorized Federal projects f or constr uction and any

major Federal agency act ion (other than a project for

construction) to which sec tion 4332(2)(C) of this title

applies, and (3) proposed regulations published by a ny

department or agency of t he Federal G overnment.

Such written comment shal l be made public at the

conclusion of any such review.

(b) Unsatisfactor y legislation, action, or reg ulation

In the event the Admin istrator determines that any

such legislation, action, or regu lation is unsatisfac-

tory from the standpoint of public hea lth or welfa re or

environmental qualit y, he shall publish h is determina-

tion and the matter sha ll be referred to the Council on

Environmental Qua lity.
