CLEARANCE CHECKLIST
Discuss nature of proposed mark.
Determine whether design elements will be included in the pro-
posed mark.
Establish whether the proposed mark is a generic or descriptive
term.
Consider potential translation or transliteration issues with the
proposed mark.
Request a preliminary trademark clearance search from a trade-
mark practitioner.
Discuss countries of interest for rollout of the proposed mark.
Consider the trademark filing strategy, including any special issues
relating to regional trademark systems and the Madrid Protocol.
Select qualified local counsel.
Request a comprehensive trademark clearance search by local
counsel.
Report local counsel’s trademark search opinion to the client.
