A. Appeals From the District Court

Appeals from the district court are de novo, unless both parties consent to an on the record appeal.217 The defendant also gets a de novo sentence that is not limited by the sentence below.218 However, as a practical matter, the district court sentence is often treated as a maximum potential sentence on appeal, and the state will often agree to a lesser sentence on appeal in return for a guilty plea.
