Apparatus lease agreement (between a Department and District)

APPARATUS LEASE AGREEMENT

This Agreement, effective by and between the ABC VOLUNTEER FIRE DEPARTMENT (“Fire Department ” or “Department ” or “Lessor”) a fire corporation under the New York Not-for-Profit Corporation Law with its principal place of business located 123 Fire Street, Somewhere , New York 14444, and the XYZ FIRE DISTRICT, (“District” “ Fire District “ or “Lessee”) a municipal corporation with its mailing address at 987 Blacktop Street, Somewhere, New York 1xxxx

WHEREAS, the Fire Department owns certain fire apparatus currently garaged at 123 Fire Street, Somewhere , New York 1xxxxx, in the Town of _________, ___________County, New York and desires to lease such fire apparatus to the Fire District, and

WHEREAS, the Fire District desires to lease from the Fire Department certain fire apparatus currently garaged at 123 Fire Street, Somewhere , New York 14444, in the Town of _________, ___________County, New York and desires to lease such fire apparatus from the Fire Department as and for Fire District purposes, and

WHEREAS the parties have mutually agreed to such lease and desire to memorialize their agreement for such lease of the Premises;

NOW, THEREFORE, the parties make and agree as follows:

Apparatus Leased: The Fire Department shall lease the fire apparatus set forth in Schedule A hereto and all hoses, ladders and miscellaneous equipment currently located on the fire apparatus (the “Fire Apparatus”) to the Fire District according to the term and conditions set forth herein.

Term: This lease shall be for a one-year period beginning through and until __________.

Lease Payment: The Lessee shall pay to Lessor the followings sums which shall be due and payable monthly. (Insert here the payment terms such as the amount of the payment, if any, and the payment due date and any other payment terms deemed appropriate.)

Conclusion of Term: At the conclusion of the Term hereunder, the fire apparatus shall be returned to Lessor and in the same condition as at the start of this Lease, reasonable wear and tear excepted. In the event that the Fire District removes any piece(s) of the Fire Apparatus from service, there shall be no offset or reduction in the lease payment owed by the Lessee to the Lessor.
