Annex 3 EPO member states and extension states as of July 2005: 157
Annex 3
EPO member states and extension states as of July 2005:
Application for a patent before the European Patent Office, either directly or
through the PCT pathway, can lead to the processing of the application and, if
granted, to a patent in all EPC member states. After granting, the patent still has
to be filed with the respective national offices. The legal force of the patent is
attained by the act of granting of the patent by the EPO.
As of May 2005, 30 states are full members of the EPC, all of which are also
members of the PCT. Another 6 states are associated within the context of the
Extension Agreement. The procedure to receive patents in those states is some-
what different, but most general provisions of the EPC also apply there.
The date of ratification of the EPC or the Extension Agreement indicates from
what filing date on a EP filing, or a PCT filing naming EP as a designated office,
includes the respective country or can be extended to the respective state.
