PCT Contracting States (as of July 7th, 2005)

Applying for a patent under the PCT,either directly to the World Intellectual Prop-

erty Organisation (WIPO) or through national or regional patent offices, has the

same effect as filing individually in each PCT member state. The PCT however

does not grant patents; the applications are further processed by national or regio-

nal offices after entering the “national phase”, typically after 30 months.

A preliminary examination can be requested under the PCT that gives the appli-

cant valuable information about the chances of receiving a granted patent in the

national phase.

A total of 126 states has ratified the PCT. Again, the date of ratification deter-

mines whether a PCT application included the respective country. The 30-month

period to start the national phase is valid for most but not all PCT member states.

Few jurisdictions have extended this period to 31 months.
