2. (§9.5) Profit à Prendre/Right of Common

Unlike a license, a profit is subject to the Statute of Frauds, so it requires a writing for its creation. See:

· 72 Am. Jur. 2d Statute of Frauds § 91 (2012) (a profit à prendre, which is a right to take a part of the soil or produce of land, is an interest in land created by grant and cannot be created by parol)

A profit à prendre, also called a "right of common," is a liberty in one person to enter another's soil and take from it the fruits not yet carried away, such as mining, logging, or drilling. See:
