E. (§9.46) Factors to Be Considered in All Termination Cases

Under §§ 211.447.6 and 211.447.7, RSMo Supp. 2019, a termination pursuant to only the unfitness ground under § 211.447.5 does not require the trial court to include specific best interest findings in the judgment, but does require that the court conclude that termination is in the child’s best interest. In re E.B.R. v. E.R., 503 S.W.3d 277, 286–87 (Mo. App. W.D. 2016) (noting that a parent may request best interest findings under Rule 73.01(c)).
