C. (§9.42) Rights and Liabilities of Owners
The rights and liabilities of the adjoining owners depend on the terms of agreement. See Thomson v. Ehinger, 612 S.W.2d 15, 15–16 (Mo. App. W.D. 1980). For cases affecting third parties, see Swentzel v. Holmes, 175 S.W. 871 (Mo. 1915). Absent agreement, either owner may make repairs for maintenance without liability to the other as long as due care is used. See Crawshaw v. Sumner, 56 Mo. 517 (1874); Bell v.
