§ 9.3.4 Miscellaneous Statutory Authorizations for Costs

A number of specific substantive statutes independently provide for recovery of costs. Most of the statutes merely state that, in addition to damages, the successful plaintiff can recover costs and reasonable attorneys' fees. See, e.g., A.R.S. § 44-1733 (voidability of sale or contract for sale of interest in pyramid promotional scheme); A.R.S. § 12-671 (liability for writing bad checks); A.R.S. § 12-815 (injunction of nuisance caused by obscene movies and publications); A.R.S. § 23-341 (under equal wage law an employee can recover in a civil action the balance due, "together with the costs of suit"); A.R.S. § 12-1538 (replevin or personal property under attachment); A.R.S. § 44-6002(I) (retail charge account agreement can provide for recovery of "court costs and for reasonable attorneys' fees" if it is referred to an outside attorney...
