B. (§9.28) Appeals

Section 472.170, RSMo 2016, governs appeals from the probate division to the court of appeals in cases in which a final adjudication as to incapacity or disability has been made. An appeal may be made by the petitioner, the respondent, any relative of the respondent, “any reputable citizen of the county in which the hearing occurred, or by an attorney for any of the foregoing persons.” Section 472.170.1. Pending the determination of the appeal, it does not operate as a supersedeas of any adjudication of the probate division “except to the extent it is specifically provided by the probate division in an order entered at the time of or after the notice of appeal has been filed.” Id.
