In 2017, the Southern District of the Court of Appeals held that failure to include the notice of the parent’s right to counsel, including the parent’s right to appointed counsel if indigent, in the summons packet was grounds for reversal of the judgment for termination of parental rights and remand for further proceedings, because the procedure mandated by § 211.462.2, RSMo 2016, was not followed. The court found that § 211.462.2 “performs an essential role in protecting the due process rights of a parent threatened with termination of his or her parental rights.
