1. Watch for the New Appellate Practice Handbook coming out soon. It's spectacular.

2. Moots Matter―Practice your argument and anticipate your hardest question.

3. Don't play fast and loose with the facts or the law―you'll be found out. There's a reason the Judge is on the bench and you're not.

4. Don't attack the lower court decision, respectfully disagree. The appellate court may remand for additional proceedings before the same judge you criticized.

5. Most cases can usually be decided on one issue. Put your best foot forward.

6. I've never seen a court punish a lawyer for not using all of their argument time.

7. Tell me what you want, what you really, really want. Be clear in asking the court...
