8.7.5 Non-Parties at Fault. Although not necessarily contractual, Arizona requires by statute, A.R.S. § 12-2506, that a person named to a lawsuit designate any non-parties at fault so that the trier of fact may apportion liability among them. Under these circumstances, the claimant will only be able to recover from the design professional the amount apportioned to them, even if the plaintiff is prohibited from directly suing or recovering from the non-party.342
