8.2.3 Claims for Medical Expenses and Unpaid Compensation

The medical expenses incurred by an employee as a result of his or her accident survive the employee’s death and are payable to the personal representative of the estate.[18] Similarly, a scheduled permanent disability award is payable in full to the personal representative of the decedent’s estate whether the award is issued before or after the employee’s death, but only that portion of an unscheduled permanent disability award that accrued before the employee’s death is payable.[19]
