Currently, there is no recognized constitutional right to a jury trial in the juvenile court. 66 But there is a statutory right to a jury in the circuit court on the issue of guilt or innocence after a transfer of jurisdiction by either the juvenile court or by the juvenile pursuant to section 16.1-269.1 of the Virginia Code. 67 The juvenile can also elect to transfer the case pursuant to section 16.1-270.
