8.10.10 Attack on Guilty Pleas after Sentencing
Defendants generally have no right to attack guilty pleas on the ground of prior constitutional violations. The Supreme Court has indicated that by pleading guilty, a defendant has balanced the likelihood of success and the advantages of a guilty plea against the strength of the prosecution's case and the risks of going to trial. A guilty plea cannot be challenged simply because the defendant miscalculated the strength of the prosecution's case.113
