a. (§7.7) Law vs. Equity

The Missouri Constitution provides a right to jury trial for civil actions at law. Mo. Const. art. I, § 22(a). No right to a jury trial exists for civil actions that arise in equity. State ex rel. Barker v. Tobben, 311 S.W.3d 798, 800 (Mo. banc 2010). The issues presented in the pleadings govern whether the cause of action arises under law or equity. State ex rel. Diehl v. O'Malley, 95 S.W.3d 82, 92 (Mo. banc 2003).
