7.16 Media Subpoena Law.
Arizona’s media subpoena law renders unenforceable a subpoena directed to anyone “engaged in gathering, reporting, writing, editing, publishing or broadcasting news to the public” that requests records relating to those activities, unless the subpoena satisfies certain prerequisites.103 Specifically, an affidavit must accompany the subpoena affirming, among other things, that (i) the requesting party has attempted to obtain the information elsewhere, (ii) the information sought is relevant to the litigation, (iii) the information is not protected by any privilege, and (iv) the subpoena is not intended to interfere with the gathering or dissemination...
