§ 6.9.2.6 Appeal of the Personnel Board's Decision. The complaining employee, the employee alleged to have committed the prohibited practice, or the employer may appeal an adverse board decision to superior court pursuant to the Administrative Review Act, A.R.S. § 12-901 et seq.⁴² Since 2012, an appeal to the superior court may no longer be tried de novo, although the statutory scheme is ambiguous.⁴³

If a court finds that a prohibited personnel practice took place, the aggrieved employee may recover attorneys' fees, costs, backpay, general and special damages, and full reinstatement.⁴⁴
