6-4 Counterclaims

As with affirmative defenses, whether the defendant can assert counterclaims depends on the specific facts of each case. Some counterclaims that show up in the case law include the following:

• breach of contract;⁵⁶
• unfair competition;⁵⁷
• tortious interference with contractual relations;⁵⁸
• tortious interference with prospective business relationships;⁵⁹
• patent infringement;⁶⁰
