§ 6.01 Introduction

The statutes of the marital property system states¹ expressly designate certain types of property as separate property. Almost all provide that property accumulated before marriage,² as well as that acquired after marriage by gift³ or inheritance,⁴ constitute separate property. Many contain express provisions that the increase in value during marriage of separate property,⁵ plus property exchanged for separate property,⁶ generally are separate property. Some statutes designate as separate property other types of property, such as personal injury recoveries,⁷ rents and profits derived from separate property,⁸ certain federal benefits,⁹ pensions,¹⁰ and professional degrees.¹¹
