5.9 DOMESTIC RELATIONS

5.901 Premarital Agreements. The validity of a premarital agreement must "be tested by the laws of the place where it is made" ⁵⁹ unless: (i) the parties have expressly manifested their intent to apply the law of another jurisdiction, (ii) the parties sign the premarital agreement in one jurisdiction but, at the time the contract was executed, intend to fully perform the agreement in a different, specific jurisdiction, or (iii) the applicable substantive law of the foreign jurisdiction is contrary to Virginia public policy. ⁶⁰

5.902 Choice of Law Is a Question...
